Judge requires EIR for controversial Los Gatos creekside development

Santa Clara County Superior Court Judge Leslie Nichols has ordered the town of Los Gatos to conduct an environmental impact review of the proposed Ross Creek subdivision.
The subdivision would be located off of Blossom Hill Road on Linda Avenue and Stephanie Lane, both of which border Ross Creek.
Judge Nichols ruled that, in approving the project, the town did not comply with the California Environmental Quality Act.
The judge’s ruling is a victory for opponents who argued the seven home subdivision would be prone to flooding and would threaten creek habitat. Opponents also said four of the homes would be built too close to the creek.
Ross Creek residents joined with the Committee for Green Foothills to stop the subdivision’s construction.
“It is our hope that the developer will embrace (the judge’s) ruling by moving the project away from the creek and limiting intensity,” Green Foothills advocate Brian Schmidt said.
The judge’s order says he will continue to monitor the issue until he has determined that the town and developer have complied with CEQA. Developer Terry McElroy said he had not seen the ruling and could not comment.
