Next Step to Protect Martin’s Beach

What’s Happening:
Surfrider Foundation and Friends of Martin’s Beach have filed legal actions challenging the owner for blocking access to Martin’s Beach (see our Martin’s Beach page for more information). The Coastal Commission, which is not a party to these lawsuits, is gathering necessary information to determine whether “prescriptive rights” exist on this property and asking anyone who has been to Martin’s Beach, to complete this survey documenting their use.

Why This Is Important:
Prescriptive rights provide that if it can be documented that members of the public have been using private land as if it were public land over a period of at least five years, the right to continued public access may be established.
